On December 19, the HACC Appeals Chamber partially upheld the defense’s appeals and overturned the ruling of the investigating judge of the HACC that had ordered pretrial detention for former MP Yurii Ivaniushchenko.

The motion seeking an interim measure will be referred for a new review by the court of first instance.

According to the HACC AC panel, Ivaniushchenko had not been properly notified of the hearing on the imposition of the interim measure.

As reported earlier, the NABU and the SAPO suspect former MP Yurii Ivaniushchenko, developer Vladyslava Molchanova, private company director Yurii Tsvihun, lawyers Kostiantyn Balandin and Anton Arefiev, as well as former head of the regional Geocadastre Mykola Tereshchenko, of orchestrating a large-scale land scheme. According to the investigation, the suspects organized the unlawful appropriation of 18 hectares of state-owned land worth more than UAH 160 million, using forged documents and official powers.
